The healthcare marketing community’s collective socks were blown off by the December 2022 HIPAA Bulletin, Use of Online Tracking Technologies by HIPAA Covered Entities and Business Associates. This bulletin defined current marketing efforts that may fall outside HIPAA compliance by intentionally or unintentionally disclosing PHI. Since then, healthcare organizations have been blindsided by lawsuits, fines, an additional bulletin, and A LOT of stress and confusion.
